Terms of Service

Welcome to Botanical Tales (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern the sale and provision of floral arrangements, including but not limited to dried flower arrangements, installations, wedding flowers, and other bespoke floral services (the “Services”) provided by Rebecca Partridge.

By placing an order or otherwise engaging with our Services, you (“Client” or “you”) agree to be bound by these Terms. If you do not agree with these Terms, you may not purchase or use our Services.

1. Scope of Services

1.1 Description
We offer floral designs, including dried flower arrangements for personal and commercial use. We also provide wedding flowers, floral installations, and bespoke design services.

1.2 Customisation
Our arrangements are often customised based on the Client’s requirements. While we strive to meet your specifications, variations in size, color, and style may occur due to the natural characteristics of the materials used.

2. Weddings

2.1 Booking and Consultations

  • An initial consultation (in person, via phone, or video call) is available to discuss design preferences, budget, and schedule.

  • We recommend booking as early as possible to secure your event date, as popular dates can fill up quickly.

2.2 Design and Material Variations

  • Floral designs are subject to availability and seasonality of materials. If a particular dried flower or foliage is unavailable, we will make every effort to source a similar substitute, maintaining overall style and quality.

  • Colour and shape variations are a natural part of dried flower arrangements. While we do our best to match your desired theme, exact colour matches cannot be guaranteed.

2.3 Venue Requirements

  • The Client is responsible for ensuring that the chosen venue permits and can accommodate floral decorations.

  • If specific requirements or restrictions (e.g., installation methods, fire safety regulations) apply to the venue, the Client must inform us during the consultation process so that we can adjust accordingly.

2.4 Setup and Breakdown

  • Unless otherwise agreed in writing, we typically handle delivery and on-site setup of wedding arrangements. Additional fees may apply for labor-intensive installations or for any requirement to return and dismantle arrangements after the event.

  • Any installations left at the venue (e.g., arches, large-scale floral backdrops) must be collected as agreed in the contract. Failure to collect these items may incur storage or disposal fees.

2.5 Cancellation Policy (Weddings)

  • Due to the nature of wedding events, cancellations and schedule changes must be communicated as soon as possible.

  • Deposit: A non-refundable deposit of £500 is required to secure your wedding date and Services. This deposit covers initial material sourcing and design planning.

  • Cancellations made 3 months before the wedding date may be eligible for a partial refund of any amount paid beyond the deposit, minus any costs already incurred.

  • Rescheduling will be subject to availability. If we cannot accommodate a requested new date, the standard cancellation policy will apply.

2.6 Liability Limitations for Weddings

  • We are not liable for any unforeseen circumstances such as venue changes, extreme weather conditions, or other external factors that could impact the event.

  • We will not be responsible for rearranging or moving flowers once they have been set up in accordance with the agreed design plan unless otherwise specified in writing.

3.Pricing and Payment

3.1 Quotations
All quotations provided are valid for 14 days from the date of issue. After this period, prices may be subject to change without notice.

3.2 Deposits
A non-refundable deposit of £500 is required to secure your booking or order (or payment in full if the total is less than £500). This deposit will be applied toward the total order value.

3.3 Final Payment
The remaining balance must be paid in full before delivery or collection of the Services. Failure to make full payment before the specified date may result in cancellation of your order and forfeiture of your deposit.

3.4 Late Payments
Payments not received by the due date may incur additional charges, including late fees or storage costs if the arrangements cannot be delivered or collected on time due to non-payment.

3.5 Accepted Payment Methods
We accept bank transfer and stripe payments. Any fees associated with the payment method are the responsibility of the Client.

4. Delivery and Collection

4.1 Delivery Dates and Times
Delivery or collection dates will be agreed upon at the time of booking. We will endeavor to meet these dates, but unforeseen circumstances (e.g., weather, transportation issues) may cause delays.

4.2 Risk of Loss
Upon delivery or collection, risk of loss or damage to the arrangements transfers to the Client.

4.3 Additional Delivery Charges
If the Client is not available to receive the delivery or if redelivery is required, additional charges may apply.

5. Longevity and Quality

5.1 Dried Flowers
Our dried arrangements are designed to last for an extended period. However, their longevity depends on environmental factors such as temperature, humidity, exposure to direct sunlight, and handling.

5.2 Disclaimer of Guarantees
While we strive to use the highest quality materials, we cannot guarantee how long any arrangement will last once it is in the Client’s care. Environmental conditions (e.g., very dry, hot, humid, or wet environments) can affect the appearance and lifespan of dried flowers and foliage. Any timeframes provided for longevity are estimates only.

5.3 Client Responsibility
The Client is responsible for proper handling and care of all arrangements upon delivery. This includes placing the arrangements in suitable conditions and ensuring they are not exposed to extreme temperatures or moisture that could reduce their lifespan.

6. Cancellations and Refunds

6.1 Cancellations by the Client

  • If the Client cancels after the deposit has been paid, the deposit is non-refundable.

  • Cancellations made after full payment may be eligible for a partial refund at our discretion, minus any costs already incurred for materials or labor.

6.2 Cancellations by the Company
In the rare event we must cancel or significantly alter the Services due to circumstances beyond our control (e.g., natural disasters, supply chain disruptions), we will inform the Client as soon as possible and endeavor to offer an alternative or issue a full or partial refund, depending on the situation.

7. Client Obligations

7.1 Accurate Information
The Client agrees to provide accurate and complete information for the design and delivery of the arrangements. This includes relevant dates, venues, addresses, and any special requirements.

7.2 Permissions
If the Services are performed on location (e.g., wedding venues or business premises), the Client must ensure that any necessary permissions or permits are in place.

7.3 Communication
Timely responses to communication are essential to the successful completion of your order. Delays in feedback or payment may result in changes to pricing, design, or delivery schedules.

8. Liability

8.1 Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, consequential, or incidental losses or damages arising out of or in connection with these Terms or our Services.

8.2 Maximum Liability
Our total liability for any claim arising under or in connection with these Terms shall not exceed the total amount paid by the Client for the specific Services giving rise to the claim, with a total maximum claim of £5,000.

9. Intellectual Property

9.1 Designs and Photography
We reserve the right to photograph all floral arrangements and use such photographs for promotional purposes, including on our website, social media, and marketing materials. If you prefer not to have your arrangements photographed or published, please inform us in writing before the date of Service.

9.2 Client Use
All designs and arrangements remain our intellectual property until payment is received in full.

10. Force Majeure

We shall not be liable for delays in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, accidents, acts of war, communication failures, or government restrictions.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England (UK). Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of England (UK).

12. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website or otherwise communicated to you. Your continued use of our Services after such updates will constitute acceptance of the amended Terms.
